In the Live Index framework

Amphitheatres occupy a specific position in the North American touring economy: large-capacity, seasonal, and concentrated in ownership. Where booking or ticketing at such a venue is exclusive to one company, the exclusivity determines who captures the fee and ancillary revenue of an entire summer season.

For an equity framework, exclusivity matters because it converts a venue relationship into a durable revenue stream, and because its removal is a plausible remedy in the antitrust record Live Index already tracks. A change in exclusivity terms is a change in segment economics, not only in competitive conduct.

The term is used here descriptively. Whether any particular arrangement is lawful is a matter for the courts, and the Live Index case tracker records the litigation rather than characterising it.
